Hyred Platform Terms of Use
These terms govern access to and use of the Hyred Platform by Brands and Creators. Hyred's managed agency services are governed by the separate Hyred Agency Terms.
This page is available in English only. Revision: 30 September 2026.
1. ACCEPTANCE OF THE TERMS OF SERVICE
1.1 Hyred B.V., registered with the Dutch Chamber of Commerce under number 42091822, with its statutory seat in Gemert and business address at Scheiweg 26, 5.01, 5421 XL Gemert, the Netherlands (hereinafter referred to as Hyred, we, us, or our) owns and operates certain websites, including https://hyred.com and the platform: https://hyred.app (collectively, the “Hyred Platform”). These Hyred Platform Terms of Use (the “Terms” or this “Agreement”) govern your access to and use of the Hyred Platform by Brands and Creators. Hyred separately offers managed agency services (the “Hyred Agency Services”, including growth partnerships), which are governed by the separate Hyred Agency Terms together with any applicable Order Form or Statement of Work, and not by these Terms. The version accepted for an Order or assignment governs that Order or assignment, subject to clause 1.2. Please read this Agreement carefully. By expressly accepting these Terms when creating an account, placing an Order, or applying for an assignment, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not accept the terms and conditions of this Agreement, you must not access, browse, or use the Hyred Platform.
1.2 These Terms, the accepted Order and the applicable Refund Policy form the agreement for Platform services. A revision applies prospectively from the effective date communicated with it. Hyred will give reasonable advance notice of material changes to ongoing services and obtain additional acceptance where required. A website update or continued browsing does not retrospectively change completed Orders, earned compensation, agreed refunds or rights already acquired in Content. Copies of the version accepted for an Order may be requested from support@hyred.nl. The revision dated 30 September 2026 is available at https://hyred.com/legal/2026-09-30/platform-terms.txt. Publication of a revision does not by itself prove that a user accepted it.
1.3 The Refund Policy at https://hyred.com/refund-policy forms part of the agreement for Platform purchases. The Privacy Policy at https://hyred.com/privacy-policy explains personal-data processing; accepting these Terms is not consent to optional advertising, analytics or other processing that requires separate consent. Managed agency services are subject to the separate Agency Terms when expressly identified as such in their Order Form or Statement of Work.
1.4 Disputes are governed by clause 13. Mandatory legal rights, including any protections that apply to a user acting as a consumer, are preserved. A business-account label alone does not exclude those rights.
1.5 Scope and Order of Precedence
For Platform Orders, specific terms and guarantees disclosed and accepted for the Order prevail over general Platform provisions on the same subject. The Refund Policy governs cancellation and refunds; a general performance disclaimer does not override an applicable commercial guarantee. A signed Order Form or Statement of Work prevails on its agreed subject matter. The Agency Terms apply only to services expressly purchased as managed agency services. A Data Processing Agreement prevails on processing performed under that agreement. Neither contractual precedence nor these Terms overrides applicable data-protection law or mandatory customer rights.
2. INTRODUCTION
2.1 The purpose of the Hyred Platform is to connect companies or buyers (“Brands”) with the social media user community (“Creators”) and to facilitate social media marketing, user-generated content, and other tasks: creating and managing relationships, organizing product/service giveaways, and enabling the purchase and distribution of user-generated content on social media; subject to compliance with these Terms. In these Terms, Brands and Creators are collectively and individually referred to as “users” or “you,” as the context requires. Whenever a Brand acts on behalf of its clients (e.g., a Brand is an agency representing multiple clients for whom the Content is created), the Creator and Hyred confirm that nothing in the Agreement restricts the Brand from sharing the Content with the Brand's clients.
2.2 Account registration and acceptance of these Terms are separate from purchasing an Order and selecting a Creator. Creating a draft, applying for an assignment, paying for an Order and approving a Creator are distinct events. The accepted Order identifies the purchased services and price; Creator selection and assignment approval identify the person producing the Content and their compensation.
2.3 Updates to these Terms follow clause 1.2. The accepted version, date and relevant account or Order should be retained with the Order records. Terms must be made available before acceptance, including for users who sign up using a social-login provider.
2.4 Hyred reserves the right to modify the Hyred Platform, its features and access arrangements at its discretion, subject to any specifically agreed service commitments and mandatory law. Account restrictions and closure are governed by clause 11. A Platform change does not itself release users from accrued payment obligations or cancel rights already acquired in Content or applicable refund entitlements.
2.5 Any costs associated with the use of the Hyred Platform remain your responsibility and depend on the service provider used.
3. USE OF THE HYRED PLATFORM
3.1 The Hyred Platform allows Brands to connect with the social media user community and/or purchase user-generated content for the purpose of:
3.1.1 Acquiring video and audio files from Creators specifically made for the Brand (“Content”), in accordance with a request submitted by the Brand on the Hyred Platform.
3.2 “Intellectual Property Rights” means all current or future intellectual property rights of any kind anywhere in the world for their full duration, including but not limited to rights related to or associated with copyright, neighboring rights, moral rights, trademarks, service marks, trade names, domain names, rights of publicity, image rights, patents, design rights, and similar rights, whether registered or registrable, including the right to apply for such rights anywhere in the world. The Brand acquires all rights, title, and interest in all Intellectual Property Rights of the Content created by the Creator and uploaded to the Hyred Platform pertaining to the Brand's product. Subject to the license granted by the Brand to Hyred in paragraph 5.5.2.2, such Content created by the Creator and uploaded to the Hyred Platform may also be used by Hyred for Hyred’s social media, advertisements, and other purposes, both within and outside the Hyred Platform. The transfer and permissions are subject only to the statutory formalities, non-waivable rights and third-party rights described in clause 5.5.7.
3.3 The relevant Brand is solely responsible for:
3.3.1 Providing an accurate, actionable, and comprehensive description of the requirements for the Content (“Task Brief”) to the Creator;
3.3.2 Facilitating free product giveaways or service trial subscriptions. If the Brand wishes to receive the product back, written approval must be obtained from us. In such a case, the Brand shall be responsible for arranging and funding the return shipment of the product, including all associated costs such as transport and handling. The Hyred Platform cannot be held responsible for any costs arising from sending or retrieving products;
3.3.3 Reviewing delivered Content and responding through the relevant approval, revision or review-comment workflow without unreasonable delay, as described in clause 5.4.5;
3.3.4 Timely payment for Content uploaded to the Hyred Platform.
3.4 The Hyred Platform allows Creators to participate in social media marketing and/or user-generated tasks by:
3.4.1 Offering customized social media marketing and/or user-generated content tasks with accurate and comprehensive requirements;
3.4.2 Creating Content for Brands in accordance with the Task Brief and/or other requirements provided in advance.
3.5 The Creator is solely responsible for:
3.5.1 Providing accurate personal, business, tax and payout information and completing payment-provider verification where required. Available earnings, a payout request, administrator approval, a transfer to a connected account and bank receipt are separate stages under clause 5.3;
3.5.2 Ensuring compliance with the Task Brief and/or other requirements provided in advance. Hyred reserves the right to reject the work of Creators until requirements are met;
3.5.3 Timely delivery in accordance with the Task Brief and/or other requirements provided in advance;
3.5.4 Including required information mandated by Hyred, the Brand, or legislation when publishing on social media channels if agreed upon by the Brand, including but not limited to advertising disclaimers.
3.6 Creators and Brands must negotiate and record the terms, payment and changes for assignments arranged through Hyred through the Hyred Platform or an authorised Hyred representative. They must not divert the same or future assignments outside Hyred in breach of clause 3.16.
3.7 You may not:
Decompile, reverse-engineer, disassemble, convert, or authorize a third party to decompile, reverse-engineer, disassemble, or otherwise convert any element of the Hyred Platform into a human-perceivable form;
Distribute or republish any element of the Hyred Platform in any way;
Resell, rent, lease, or lend any element of the Hyred Platform;
Defeat, disable, or circumvent any security feature of the Hyred Platform;
Transfer any element of the Hyred Platform to a third party.
3.8 To use the Hyred Platform, users must be eligible to use social media platforms (under the prevailing terms and conditions of the relevant platforms). By using social media applications or features on the Hyred Platform, the Creator also consents and agrees to the specific terms of use of the social media Platform.
3.9 The Creator is solely responsible for their interactions with other users of the Hyred Platform. The Creator agrees that Hyred and the Brand are not responsible for the conduct of any user.
3.10 You may not use crawling, scraping, caching, or any other automated means to access any content on the Hyred Platform, except with written permission from Hyred.
3.11 For ordinary Platform purchases, Hyred supplies the purchased content, editing and scriptwriting services to the Brand and separately engages and pays Creators for their assignments. Brands pay Hyred; Creators request their agreed compensation from Hyred. Creator selection by a Brand does not by itself make the Creator the seller on the Brand invoice. An expressly agreed different arrangement must identify the supplier and payer in the Order. Creators perform assignments independently; these Terms do not create a partnership or, by themselves, an employment relationship.
3.12 Subject to compliance with these Terms by the Brand and Creator, the Brand and Creator are granted a limited, revocable, non-exclusive, and non-transferable license to access and use the Hyred Platform in the manner expected in these Terms. Any costs associated with accessing and using the Hyred Platform generally remain the responsibility of the Brand and Creator and depend on the service provider used. The Brand and Creator are responsible for ensuring that the respective computer system or mobile device they use to access the Hyred Platform is compatible with the Hyred Platform and meets all relevant technical specifications necessary to use the Hyred Platform.
3.13 The Hyred Platform may contain links to other sites not maintained by Hyred (“Linked Sites”). Hyred is not responsible for the content of any Linked Site, regardless of whether Hyred is affiliated with the Linked Site. Hyred in no way recommends any Linked Site and is not responsible for the quality or delivery of products or services offered, obtained, or advertised by such Linked Sites. To the extent these Linked Sites collect personal information or contributions from the Creator, Hyred bears no responsibility or liability for how such information or postings are used or exploited. The Linked Sites are solely for the convenience of the Creator, and the Creator agrees to use them at their own risk.
3.14 You acknowledge and agree that the Hyred Platform may access information you may have shared with the relevant social media platform and may contact you via the social media platform or via the information you shared (e.g., by sending an email directly to you or to the email address provided to the social media platform), in accordance with the permissions you granted via the social media platform. You are encouraged to review the Terms of each social media platform before engaging or interacting with the social media links, applications, or features on the Hyred Platform. The Hyred Platform is in no way sponsored, endorsed, administered by, or associated with any social media platform.
3.15 The Brand grants Hyred the unconditional and non-exclusive right to use the Brand's name, logo, and other trademarks or service marks in all forms of marketing, promotional material, and public relations activities indicating that the Client is working or has worked with Hyred. This includes, but is not limited to, use in online media, social media, advertisements, press releases, and promotional materials. The Brand confirms that Hyred may use such information in a way that reasonably contributes to the positive promotion of both parties without harming the brand's reputation. The Brand reserves the right to request in writing the adjustment or removal of such use if reasonably necessary.
3.16 Non-circumvention. Hyred invests in acquiring customers, recruiting Creators, making introductions and managing assignments. Without Hyred's prior written consent, a Brand and a Creator introduced to one another through the Hyred Platform, an application, an Order or Hyred's services must not directly or indirectly solicit, offer, negotiate, arrange, accept or carry out the same or future content, marketing or related assignments with one another outside Hyred. This includes acting through another agency, an affiliate, an intermediary or any other person to bypass Hyred, and applies regardless of which party initiates contact. The restriction applies from the introduction, throughout any Hyred assignment between them and for twenty-four (24) months after completion or termination of their most recent Hyred assignment; if no assignment results, the period ends twenty-four (24) months after the introduction. Closing an account does not end the restriction. A claim of an earlier relationship is not an automatic exemption for an assignment introduced or arranged by Hyred; any agreed exemption must be recorded in writing by Hyred. Hyred may grant a written release for defined assignments on an agreed conversion fee or other expressly recorded terms, only where legally permitted; no fee is imposed for a protected statutory working relationship. Users must promptly inform Hyred of an approach that would breach this clause. Hyred may suspend or terminate access under clause 11 and seek an injunction, recovery of proven losses including lost fees or margin, and recoverable enforcement costs. This clause does not restrict an employment or other working relationship protected by mandatory law, including article 9a of the Dutch Waadi where applicable. It creates no fee or penalty for exercising such a protected right. Mandatory limits on the scope or enforcement of this restriction remain applicable.
4. REGISTERING AN ACCOUNT
4.1 To use the Hyred Platform, users must register an account via the Hyred Platform as required and set forth in these Terms.
4.2 Hyred reserves the right to refuse registration, restrict eligibility or cancel an Account at its discretion, including for commercial, capacity, verification, security, compliance or service-related reasons, subject to mandatory law. Existing Orders and account closure are handled under clause 11.
4.3 All information provided when registering an Account must be current, correct, and complete. Incomplete, unsuitable, or unintelligible Account registrations will not be accepted. You must be logged into your Account in the required manner whenever you wish to use the Hyred Platform. You may never use someone else's account without Hyred's permission.
4.4 You are responsible for keeping your account details strictly confidential and for all activities under your account. You agree to notify Hyred immediately of any unauthorized use of your account or any other breach of security. It is your own responsibility to manage access to and use of your account and to notify Hyred when you wish to cancel your account. Hyred is not responsible or liable for any loss or damage resulting from your failure to comply with this provision.
4.5 Hyred may suspend or terminate an Account or access to any part of the Hyred Platform if it reasonably believes a user has misused or manipulated the Platform, provided misleading information, breached these Terms, circumvented Hyred or engaged in unlawful or other improper conduct affecting the Platform, its users or Hyred's legitimate business interests. Protective action need not await completion of an investigation or a prior opportunity to remedy where immediate action is reasonably necessary. Clause 11 and mandatory legal requirements apply.
4.6 The use of automated software or any other mechanical or electronic means by which a user can create accounts is prohibited. Hyred reserves the right to suspend or terminate your account if it believes you are engaging in such activities.
4.7 Account, profile, message, order, uploaded-media and payment-related personal data are processed as described in the Privacy Policy. Social-login and payment providers may also process information under their own notices. Users are responsible for information and Content they submit and must have authority to share other people's information for an Order. Interface deletion is not a representation of immediate permanent erasure from storage or records. To the extent permitted by law, users must indemnify, defend and hold harmless Hyred, its associated companies and relevant social-media platforms against third-party claims, losses and reasonable costs arising from the user's unlawful or infringing Content or information, unauthorised disclosure or breach of these Terms, to the extent attributable to that user. This obligation does not require a user to indemnify Hyred for Hyred's own breach or liability that cannot lawfully be shifted. Questions and complaints concerning Hyred must be directed to Hyred, rather than to a social-media platform.
5. TERMS APPLICABLE TO CREATORS
5.1 Eligibility of Creators
5.1.1 To register a Creator Account on the Hyred Platform, the person must be 18 years or older.
5.1.2 To participate in tasks and earn compensation via Hyred, Creators must meet the following minimum standards:
5.1.2.1 Their social media channels (including, but not limited to, Instagram and Facebook) must not contain inappropriate, unethical, or disrespectful Content, or Content that violates these Terms or the terms of the relevant social media platform.
5.2 Additional Terms for Creator Accounts
5.2.1 If a Creator does not meet the minimum standard, the Creator may not be able to participate in tasks or have access to the full functionality of the Hyred Platform.
5.3 Compensation for Creators
5.3.1 Compensation is the amount agreed for the assignment. Work in progress is distinct from available earnings. Creator Content becomes eligible for compensation when approved by the Brand or approved by Hyred through the administrator review process in clause 5.4.5. Where an Order includes separate in-house editing, approval of the Creator's source material and approval of the final edited video are separate events.
5.3.2 The Creator agrees that by uploading the content to the Hyred Platform, the Creator transfers all rights, title, and interest in all Intellectual Property Rights in the content to the Brand and may not post such content on their own social media channels unless permitted by the Brand.
5.3.3 Hyred may verify a payout request and withhold or defer payment where information or an invoice is missing or inaccurate, provider verification is incomplete, an assignment or entitlement is disputed, or there are reasonable grounds to investigate fraud, infringement, a duplicate payment or unlawful activity. The scope and duration of a hold must relate to the reason for it and comply with applicable payment law. Hyred may request evidence and reconcile uncertain transfers before retrying them. A Brand chargeback does not automatically establish non-performance by the Creator. A Creator may contact support@hyred.nl about the request. No fixed administrator-review deadline, unconditional payout promise or automatic release on expiry of an internal review period is created by these Terms.
5.3.4 Content rights are governed by clause 5.5. The Brand's acquired rights do not depend on how long Hyred's internal payout administration or the Creator's bank processing takes.
5.3.5 Where the Creator asks Hyred to generate a payout invoice on their behalf, the Creator authorises self-billing for the identified assignments. The Creator is the supplier and Hyred is the customer on that invoice, even where Hyred prepares the document. The Creator must supply correct invoice numbering, business and VAT information, review the invoice and promptly report errors to support@hyred.nl. Hyred and the Creator will correct errors and avoid issuing a second invoice for the same supply. Creators must update changes in their business or VAT status and remain responsible for their own tax obligations.
5.3.6 Hyred may request and verify information and provide reports or notifications where tax-reporting law requires it, including platform-reporting rules where applicable. Use of Stripe does not determine or replace Hyred's own reporting obligations. This clause does not represent that a DAC7 applicability assessment has already been completed.
5.3.7 An eligible Creator requests a payout for available assignments and supplies the required invoice and payment details. The request is reviewed by an administrator. For Stripe-connected payouts, verification and active transfer capability are required. Administrator approval initiates a transfer to the connected account; it is not proof of bank receipt. The earnings interface states that payment is transferred to the bank within one week after administrator approval. Provider or bank delays and verification problems will be explained when identified. Approval of the underlying work is not itself an immediate bank payout, and Stripe processing is not described as escrow.
5.4 Terms for Participation in a Task
5.4.1 The accepted Brief and purchased configuration define the deliverables: the agreed video duration, source material, hook variants, photographs and any editing, subtitles, music or scriptwriting. Requirements must be made available before the assignment is accepted. A later material change to the concept, product, filming or deliverables requires agreement on scope, price and timing. A draft upload or the most recent visible clip does not by itself establish that the entire Order is complete.
5.4.2 The creator undertakes to complete and deliver the task in accordance with the instructions, specifications, and deadlines provided by the client. The creator acknowledges that receiving the necessary product or material without completing and delivering the task is a violation of these general terms and conditions.
5.4.3 Creator guarantees that the content created for each task includes the following:
5.4.3.1 Creator is of legal age to create, own, and manage social media accounts.
5.4.3.2 Creator owns the Intellectual Property Rights of the Content and is not restricted from performing their obligations to transfer the Intellectual Property Rights of the Content to the Brand as set forth in these Terms.
5.4.3.3 The Content does not infringe upon the privacy rights, contract rights, or other rights (including Intellectual Property Rights) of any person, company, or entity.
5.4.3.4 The Content contains no misleading information or suggests that the Creator or a third party has approval or sponsorship from another party that the Creator or that third party does not have.
5.4.3.5 All statements in the content regarding the Creator’s use and experience with the Brand, or the Brand's products or services, are true and correct and represent the Creator’s opinion, regardless of whether the Creator is paid for this Content, and fairly reflect the Creator’s user experience. Creator will notify Hyred immediately if their opinion of the Brand changes from what the Creator has expressed to date.
5.4.3.6 The relevant Content contains no statements or material that the Creator knows or suspects (or reasonably should have known or suspected) to be false, misleading, or deceptive.
5.4.3.7 The relevant Content is original and contains no materials previously broadcast, streamed, published, posted on a social media channel, or otherwise made public by the Creator, and contains no materials used in previous marketing materials or promotions for a third party or that otherwise violate the rights of a third party.
5.4.3.8 Creator has not entered into any other agreement, arrangement, or understanding with a guild, union, industrial organization, or other third party that hampers or limits compliance with these Terms, restricts the performance of Creator’s obligations, limits the rights and benefits set forth herein, or leads to a conflict of interest.
5.4.3.9 The use of the Content and the exercise of Intellectual Property Rights on the Content by the Brand and Hyred will not infringe any Intellectual Property Rights or other legal rights of any person or entity, nor lead to any liability or obligation to pay compensation to any person or entity.
5.4.4 Penalties for Non-compliance:
5.4.4.1 In the event that the Creator, following receipt of the necessary products, materials, information, or files, fails to complete and deliver the assigned task within a period of fourteen (14) days-subject to a contrary, explicitly agreed and recorded deadline as prescribed by the client-and/or becomes unreachable via the contact methods specified on hyred.app, the Creator may be subject to a fine. This fine equals the recorded value of the uncompleted video assignment, plus the attributable shipping and sent-product costs and documented compensation for Hyred's time and efforts, with a minimum total amount of fifty euros (€50). The calculation and payment process in clause 5.4.4.2 apply.
5.4.4.2 The fine is a contractual penalty intended to encourage compliance and protect Hyred's legitimate interests; it is not limited to proven actual loss. Hyred's notification must identify the affected assignment, the breach, the applicable deadline and each component of the calculation. The assignment value is the value recorded for that uncompleted assignment. Product and shipping amounts must relate to that assignment, and compensation for Hyred's time and efforts must be itemised on a documented reasonable basis. Where legally required, the Creator must first be placed in default. The fine becomes payable on notification and must be paid within 30 days. Any applicable judicial power to moderate the fine remains unaffected.
5.4.4.3 If the fine is not paid within 30 days of notification, Hyred reserves the right to take legal action, including but not limited to engaging a bailiff or starting a lawsuit.
5.4.4.4 To the extent legally permitted and in express deviation from the default rules in article 6:92 of the Dutch Civil Code, a fine does not remove Hyred's right to require performance, product return, cessation of a breach or compensation for recoverable loss exceeding the fine. Amounts representing compensation for the same loss are credited against one another to avoid double recovery. A required product return must follow the agreed return arrangement or a written return instruction with a reasonable deadline; recoverable loss may include the attributable product and return costs. Circumvention and unauthorised publication, licensing, resale or reuse may result in removal, suspension or termination, injunctive relief and recovery of proven losses, including lost fees or margin and recoverable enforcement costs. No unspecified additional fixed fine is imposed for those separate breaches.
5.4.5 Delivery, review and approval
5.4.5.1 The Brand must review each delivered assignment promptly and, for Creator source material, submit a specific objection within seven elapsed calendar days after the latest relevant upload. An objection must identify the affected deliverable and the departure from the accepted Brief or missing material. Creator source material, photographs, scripts and in-house edited videos are distinct deliverables. An objection to one deliverable does not by itself reopen approved work or suspend unrelated services or amounts, unless the issue materially affects them. A changed concept or new filming requirement is new scope rather than a defect merely because the Brand now prefers a different approach. Included editing revisions remain available under clause 5.4.5.4. An objection must be reported through the revision workflow, review comments or Hyred support.
5.4.5.2 For Creator clips, the Platform's overdue-review process uses seven elapsed calendar days after the latest visible clip upload. Eligible items enter a queue for administrator review; queue entry and silence alone do not approve the Content. Before approving an item, Hyred must check delivery against the assignment and any outstanding revision or dispute. Active revisions must be resolved before approval. A new upload may require further review. Administrator approval is recorded as Hyred approval and is not a customer rating.
5.4.5.3 In-house editing uses the applicable editing-request workflow or the versioned review interface, where the Brand can leave comments and review hook variants and subsequent versions. Comments close when that edited deliverable is approved. The seven-day Creator-clip queue does not automatically approve an in-house edited video.
5.4.5.4 Unlimited editing revisions, where included in the purchased service, cover changes within the agreed Brief and editing scope. They do not include a new concept, additional filming or other new production work. The older Creator-edited workflow permits one edit request; that interface limit does not reduce an express unlimited in-house editing offer or remedies for materially non-compliant work. No general three-revision limit applies under these Terms.
5.4.5.5 Approval does not waive claims concerning fraud, infringement or defects that could not reasonably have been identified during review. Revision disputes or missing material deliverables may be reported to support@hyred.nl.
5.4.5.6 Commercial publication, advertising, distribution or other commercial use by the Brand or its client constitutes acceptance of the used deliverable in respect of departures from the Brief that were reasonably observable when it was used. Internal review, testing solely for approval and reporting an objection are not commercial acceptance. This does not approve undelivered parts, waive hidden defects, fraud or infringement, remove included editing revisions, or change eligibility for an applicable performance guarantee. Silence alone has the administrator-review effect described in clause 5.4.5.2, rather than automatic acceptance of every part of an Order.
5.5 Rights to the Content
5.5.1 All right, title, and interest in all Intellectual Property Rights in the created Content is transferred to the Brand. The transfer is agreed on upload as set out in clause 5.5.4, subject to clause 5.5.7; it is not conditional on approval of the Content or payment of the Brand purchase price or Creator payout.
5.5.2 As part of the agreed assignment compensation, the Creator agrees to grant the following in connection with each piece of Content:
5.5.2.1 The right to edit and reformat the Content into such formats or versions for use by the Brand;
5.5.2.2 A transfer to the Brand of all rights, titles, and interests in all intellectual property rights to the Content created by the Creator that is uploaded to the Hyred Platform and pertains to the Brand's product, without further notice or permission from the Creator or further compensation due to the Creator. The Brand grants Hyred a royalty-free, perpetual, worldwide, irrevocable, non-exclusive, transferable license to use, edit, and reformat the Content for the sole purpose of marketing and promotion of the Brand and/or Hyred (and the Hyred products and services to which this Agreement relates), without further notice or permission from the Creator or further compensation due to the Creator. The Brand reserves the right to request adjustments or removal of such use by Hyred in writing if reasonably deemed necessary.
5.5.2.3 The right for the Brand to use the identity of the Creator, the copyrighted work, and the performances of the Creator in the Content and to communicate the Content to the public in all languages, in all media, including but not limited to:
In all online paid media (including but not limited to digital banners);
In all online owned media (including but not limited to the Hyred website and Hyred internal communications);
In all social media (including but not limited to the Brand's social media channels);
In any other media (including internet websites, television, and radio) and in any earned media or public relations activity published by a third party (including but not limited to public or private events and print, digital, and/or social media).
5.5.2.4 The right to use, share, comment on, and repost the relevant content in all media, including social, online, digital, or other communication channels on which the content was published.
5.5.3 The Creator acknowledges and agrees that the Brand is not obligated to remove any content or part thereof from any of its social, online, digital, or other communication channels, or any comment, share, or repost of the content.
5.5.4 The Creator acknowledges and agrees that after uploading the Content to the Hyred Platform, the content and all Intellectual Property Rights resting on the content-including but not limited to all individual clips, images, sounds, texts, and other components forming part of the Content-irrevocably and immediately become the property of the Brand. This transfer is absolute, worldwide, perpetual, and for all purposes including, without limitation, the re-transfer of the Content to another person or entity, licensing the Content to another person or entity, making any modifications, improvements, adjustments, or versions of the Content, creating derivative works, and includes every release of the post in any medium. Creator agrees that, at Hyred's request, they will sign all documents and provide all information necessary to perfect the Brand's title in all Intellectual Property Rights in the content. This includes uploaded raw footage, drafts, rejected takes and component files created for the relevant Brand assignment; these are not excluded merely because they have not been approved or purchased as a separate deliverable. Clause 5.5.7 applies to the legal completion of the transfer.
5.5.5 Creator acknowledges and agrees that the Content may under no circumstances be posted on Creator’s channels or published in any other way, including reposting or responding to the Content after it has been posted or shared by Hyred or a Brand. The Creator irrevocably undertakes, without prior written permission from the Brand, not to use, transmit, share, distribute, or otherwise disclose the Content or any part thereof after uploading the Content to the Hyred Platform.
5.5.6 To the maximum extent permitted by law, the Creator waives moral rights that may lawfully be waived, including the right to require attribution and the right to object to permitted changes to the work or its title. The Creator expressly permits the Brand, Hyred and their successors, licensees and assigns to use, reproduce, publish, transmit, adapt, edit, reformat and combine the Content, in whole or in part, and to publish it without naming the Creator. This does not waive moral rights that cannot lawfully be waived, including the statutory right to oppose a prejudicial distortion or mutilation.
5.5.7 The agreed upload-based transfer must be completed using any legally required signed deed or other formality. The Creator must promptly execute the documents and provide the information requested by Hyred to effect and evidence the transfer; an upload or acceptance log alone is not represented as completing every statutory formality. Only rights the Creator owns or is authorised to transfer can pass. The Creator must obtain the rights and performer permissions needed for the uses specified here and must disclose third-party licence restrictions before using third-party materials; the Brand does not acquire ownership of another rightsholder's licensed music or stock assets. Hyred must secure the necessary rights for contributions it separately commissions. Mandatory author-remuneration, moral-rights, portrait and data-protection rules remain applicable. The permissions in these Terms do not require a separate promotional opt-in for each use, subject to those mandatory rules and any expressly agreed confidentiality or launch embargo. Content rights and Hyred's promotional licence survive account closure and remain distinct from file hosting under clause 11.
5.5.8 For new Creator applications, the assignment-specific rights document expressly identifies the assignment, recipient Brand, commissioned materials, upload-based transfer, permitted uses, continuing Hyred promotional permission and applicable limitations. The Creator must review it and personally sign it using the authenticated signing process. Hyred retains the document, signature evidence and accepted version and makes the saved copy available to the signer and authorised assignment parties. An administrator's account-switching action is not the Creator's personal signature. A material change to the recipient or grant requires a corresponding further instrument; rights from other contributors must be secured separately. The parties agree to electronic execution and retention, subject to mandatory signature and transfer requirements.
5.6 Restrictions for Creators
5.6.1 Creators must not publish confidential Order information or knowingly false or unlawful statements about a Brand, its products or Hyred. They must give truthful accounts of their experience and comply with applicable advertising-disclosure requirements.
5.6.2 Nothing in these Terms prohibits truthful complaints, honest testimony, legal proceedings, regulatory reporting or the exercise of statutory rights.
6. ADDITIONAL TERMS FOR BRANDS
6.1 Further Terms for Brand Accounts
6.1.1 To register a brand account, the brand must access the Hyred Platform and register in the prescribed manner, including providing the brand's full name, email address, and phone number. No costs are charged to create a brand account.
6.2 Payment Terms for Brands
6.2.1 The Brand pays Hyred the price, add-ons, discounts, credits and applicable VAT shown for the purchased Order or upgrade. Payment for an Order, production approval and final Content approval are separate events. New scope or a paid upgrade requires the corresponding purchase or agreement.
6.2.2 Payment is made using an available method shown at checkout, including Stripe-supported methods or PayPal where offered. Any permitted additional fee must be disclosed before purchase. A payment marked as processing is not yet confirmed payment; the Platform reconciles the provider result before confirming the Order.
6.2.3 Brands may be required to make an additional advance payment for the task if:
6.2.3.1 Creators are asked to purchase products/services from Brands before creating Content for the task;
6.2.3.2 Hyred, at its sole discretion, identifies a threat to the interests of the Creator.
6.3 Payment of all invoices must be made in accordance with these Terms.
6.4 When you create a task for your Brand, you represent that you are an authorized user of the card or account mentioned on your Brand Account (if applicable) and that you will pay the applicable costs, that the provided card details are current, correct, and complete, and that your designated card or account (if applicable) will cover the full amount of the costs. You may not pay or attempt to pay costs through fraudulent or unlawful means. Upon receipt of your task, we may perform a standard pre-authorization check of your designated card or account (if applicable) to verify the provided details and ensure there are sufficient funds to fulfill the task budget. The relevant task cannot be started until this pre-authorization check is completed.
6.5 If payment is overdue or cannot be processed within the required payment period, Hyred reserves the right to charge the contractual late-payment fee at ten percent (10%) per annum, but not less than EUR 10.00 per month, for business customers, to the extent legally enforceable. If that provision cannot lawfully be applied, applicable statutory interest and recoverable collection costs apply instead. Hyred may withdraw credit facilities, suspend current tasks or restrict or terminate Platform access under clause 11, without waiving its claim for payment. Mandatory consumer limits and any legally required notice or opportunity to pay apply; the contractual minimum does not override them. The same delay or cost will not be recovered twice under different labels.
6.6 Terms for Tasks
6.6.1 Hyred reserves the right, at its sole discretion, to reject tasks that do not comply with these Terms or applicable law.
6.6.2 When creating the task, you agree to the calculated price per Content piece and confirm the task budget.
6.6.3 You may not attempt to instruct, coerce, or manipulate the Creator to hide the commercial relationship between the Brand (advertiser) and the Creator. Such attempts may result in the immediate removal of the Brand from the Hyred Platform.
6.6.4 You acknowledge and agree that your right to use Content is strictly limited in accordance with these Terms.
6.6.5 You guarantee that:
6.6.5.1 You own the intellectual property rights to the Content you upload to the Hyred Platform and have the right to license the Content to Hyred and the Creators in the manner set forth in these Terms; or
6.6.5.2 You have the right to license the Content to Hyred and the Creators in the manner set forth in these Terms; and
6.6.5.3 You will not encourage or facilitate any misleading or suggestive statements or representations that the Brand or any other entity has approval or sponsorship from another entity where the Brand or entity has no such approval or sponsorship;
6.6.5.4 All Content you upload to the Hyred Platform contains no statements or materials that you know or suspect (or reasonably should have known or suspected) to be false, misleading, or deceptive.
6.6.5.5 The Brand is responsible for the legality of its products and services, the accuracy and substantiation of product and advertising claims it supplies or instructs, rights in its names, trademarks and materials, and lawful instructions and intended advertising uses. It must provide supporting evidence and required warnings or disclosures when reasonably requested and must not instruct a Creator to give a false account of personal experience. The Brand must review the final advertisement and approve its claims, disclosures and intended use before publication. Hyred's creative, editing or quality review is not independent legal, regulatory or product-claim clearance unless expressly purchased and agreed in writing. This allocation does not excuse Hyred or a Creator from their own non-transferable legal obligations.
6.6.6 Brand acknowledges that Creators are independent third parties and are not directly controlled by Hyred. As a result, any Content inherently carries a risk of negative or unfavorable comments about the content, products, or services of the Brand.
6.6.7 Commercial performance depends on factors outside Hyred's control and is not generally guaranteed. This disclaimer does not override a specific guarantee advertised and applicable to the purchased Order. In particular, the existing performance offer allows a request for a 50% purchase-amount refund when none of the first five Hyred ads outperform the Brand's current ads, after ordering at least five videos and giving Hyred a fair test, as described at https://hyred.com/refund-policy#performance-guarantee. The relevant offer and purchase record govern eligibility. Testing evidence should identify the current-ad baseline, result metric, dates, spend and attribution settings so the comparison can be assessed. Hyred must not impose undisclosed new thresholds, deadlines or exclusions after purchase. Any Creator replacement or other specific guarantee offered for the Order is handled according to that offer and the Refund Policy.
7. HYRED INTELLECTUAL PROPERTY
7.1 All Hyred materials on the Hyred Platform are protected by all applicable laws, including copyright and trademark laws, unless otherwise specifically stated, and may not be used except as permitted in these Terms. Nothing in these Terms shall be construed as a transfer, assignment, or grant of any ownership rights in any Intellectual Property Rights in the Hyred materials to a Brand or Creator.
7.2 All rights, title, and interests in all Intellectual Property Rights in all Hyred brands, logos, images, buttons, codes, layout, text, content, and products and services as displayed on the Hyred Platform (“the Brand Features”) are the property of Hyred and shall at all times remain or become the property of Hyred. Your use of the Hyred Platform shall under no circumstances be construed as a transfer, assignment, or grant of any ownership rights in any of the Brand Features or the Hyred Platform. Hyred grants you, on a case-by-case basis and to the extent necessary, a limited, non-exclusive license to use the Brand Features solely for the purpose and to the extent necessary to enable you to use the Hyred Platform.
7.3 Hyred retains ownership of its pre-existing and reusable intellectual property, including templates, production methods, workflows, software, code, tools, reusable assets and internal materials, whether developed before or independently of an Order. Commissioning Content does not transfer those materials merely because they were used to produce it or incorporated in a deliverable. To the extent Hyred-owned background material is embedded in commissioned Content, the Brand receives a worldwide, continuing, royalty-free licence to use, reproduce, adapt, distribute and sublicense it as part of the Content for the permitted Content uses. That licence is not conditional on approval or a later payment milestone and does not permit separate extraction, sale or licensing of Hyred's tools or background materials. Brand-specific commissioned Content remains subject to the broad rights in clause 5.5; third-party materials remain subject to their valid licence terms.
8. REPRESENTATIONS AND WARRANTIES OF CREATOR & BRAND
8.1 Creators and Brands participating in the Hyred Platform warrant, represent, and guarantee that:
8.1.1 All information you provide to Hyred when registering an Account is true, accurate, complete, and not misleading;
8.1.2 Any third-party social media accounts to which you link the Content:
8.1.2.1 Are your own Accounts;
8.1.2.2 If the Account refers to a Brand, you are the authorized representative of the Brand with the right to access its social media accounts and represent its interests; and
8.1.2.3 If the Account refers to an individual other than yourself, you are the authorized representative of that person with the right to access his or her social media accounts and manage his or her interests;
8.1.3 You have the right and authority to create an Account and agree to these Terms, including, where applicable, the authority of a Brand or individual to create an Account, agree to these Terms, and use the Hyred Platform on their behalf;
8.1.4 You are authorized to submit Content, where applicable, upon invitation via the Hyred Platform;
8.1.5 Every piece of Content you submit to the Hyred Platform will not contain anything that:
8.1.5.1 Is illegal or violates any laws, applicable industry codes, or requirements or guidelines of relevant regulators;
8.1.5.2 Is wholly or partially copied or adapted from any other work or material;
8.1.5.3 Is indecent, obscene, threatening, discriminatory, harassing, in breach of any confidence, defamatory, offensive, or contains, depicts, or alludes to or promotes aggressive, uncontrolled, anti-social, obscene, or illegal behavior or sexually suggestive images;
8.1.5.4 Contains knowingly false or unlawful statements about Hyred or its services; truthful complaints and the activities protected by clause 5.6.2 are permitted;
8.1.5.5 Solicits passwords or personal information for commercial or unlawful purposes or provides phone numbers, street addresses, last names, URLs, or email addresses (unless as part of a task);
8.1.5.6 Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing illegally obtained computer programs or links thereto, providing information to circumvent manufacturer-installed copy protection devices, or providing illegally obtained materials;
8.1.5.7 Involves the transmission of junk mail, chain letters, unsolicited mass mailing, or spam; or
8.1.5.8 Infringes upon the privacy rights, contract rights, or other rights (including intellectual property rights) of any person, business, or entity.
9. ACKNOWLEDGMENTS
9.1 Brand and Creator acknowledge that:
9.1.1 Brand may arrange for Creator to be sent a sample product or choose to reimburse the costs for purchasing the product or service. In both cases, the trial of the product or service is free for the Creator.
9.1.2 Hyred is in no way responsible or liable for the late delivery or non-arrival of products sent by a Brand to a Creator.
9.1.3 Rights in the purchased Content are acquired under clause 5.5, subject to its conditions and any necessary formalities.
9.1.4 Nothing in these Terms grants the Creator any ownership rights to the intellectual property rights of the Brand.
9.1.5 Nothing in these Terms requires the Brand to use any of the rights granted to the Brand by the Creator under this agreement.
9.2 Creator agrees to indemnify, defend, and hold harmless Hyred and its related entities, personnel, servants, and agents from and against any loss, damage, and costs, including reasonable attorneys' fees, arising from any claim, demand, action, suit, or proceeding brought by a third party relating to:
9.2.1 Access to the Hyred Platform in violation of this Agreement;
9.2.2 Breach by Creator of these Terms or of any of the warranties or covenants given or made by Creator;
9.2.3 Your content, if this content does not comply with the terms of a Task Description or other instructions provided by the Brand;
9.2.4 Your violation of any applicable laws, rules, or regulations; and
9.2.5 Any misleading information provided by you.
9.3 Brand agrees to indemnify, defend, and hold harmless Hyred, its subsidiaries, and respective directors, officers, employees, successors, agents, and assigns from and against any loss, damage, and costs, including reasonable attorneys' fees, arising from any claim, demand, action, lawsuit, or proceeding brought by a third party relating to:
9.3.1 Access to the Hyred Platform in violation of this Agreement;
9.3.2 Breach by Brand of these Terms of Use or any of the warranties or covenants given or made by the Brand;
9.3.3 Any claim or allegation that your Content infringes the rights of a third party, including intellectual property rights;
9.3.4 Your violation of applicable laws, rules, or regulations.
9.3.5 Unsubstantiated or unlawful product or advertising claims supplied or instructed by the Brand, missing permissions or required disclosures, unlawful products, or the Brand's publication or use contrary to its obligations under clause 6.6.5.5, to the extent the claim is attributable to the Brand rather than Hyred's own unauthorised conduct.
9.4 Hyred represents that it owns or has sufficient rights to provide lawful access to the Hyred Platform and to grant the rights it expressly grants in Hyred-owned materials. This representation does not warrant ownership of Brand or Creator materials, validate supplied product claims or certify every combination, modification or intended use by a user.
9.5 Subject expressly to the aggregate cap and exclusions in clause 10.2, Hyred will indemnify the Brand against damages finally awarded by a competent court or payable under a settlement approved by Hyred, and reasonable necessary defence costs, for a third-party intellectual-property claim directly caused by the Brand's authorised use of the unmodified Hyred Platform or Hyred-owned materials supplied for the Order. It does not cover Brand or Creator materials or instructions, product claims, unauthorised modifications, combinations not supplied or authorised by Hyred where the claim would not otherwise arise, or continued use after Hyred provides a reasonable non-infringing alternative or instructs cessation of the infringing use. The Brand must promptly notify Hyred, preserve relevant evidence, reasonably cooperate and make no admission or settlement without Hyred's consent. Hyred controls the defence and settlement of claims under this clause, but cannot impose an admission of wrongdoing or a non-monetary obligation on the Brand without its consent. Hyred may obtain continued-use rights, modify or replace the affected material or terminate the affected service and refund its unused portion where appropriate. This limited indemnity replaces a general indemnity for every contractual or legal breach; mandatory remedies and express Order guarantees remain unaffected.
9.6 The Party seeking indemnification under clauses 9.2 and 9.3 of this Agreement (“Indemnified Party”) shall make reasonable efforts to promptly notify the other Party (“Indemnifying Party”) in writing of any claim for which the Indemnified Party seeks indemnification. The Indemnified Party shall cooperate reasonably in the defense of such a claim, at the expense of the Indemnifying Party. The Indemnifying Party may not settle any claim against the Indemnified Party without the prior express written consent of the Indemnified Party, which shall not be unreasonably withheld, conditioned, or delayed. The Indemnified Party may participate in the defense of a claim through counsel of its own choosing at its own expense; however, if the Indemnified Party reasonably determines that the Indemnifying Party is unwilling or unable to defend the interests of the Indemnified Party, the Indemnified Party may assume the defense against any claim at the expense of the Indemnifying Party. The indemnification obligations survive termination. Claims under clause 9.5 follow its specific procedure, which prevails over this clause.
9.7 Unless otherwise agreed in writing between the parties, the Brand acknowledges and agrees that Hyred has the right to publicly mention—including but not limited to on its website, marketing materials, and other public communications—that the Brand has had a business relationship or collaboration with Hyred. This disclosure may include the Brand's name, website, logo, and the general nature of the collaboration, but will not reveal confidential information of the Brand without the Brand's express written consent.
10. LIMITATION OF LIABILITY
10.1 Users must not upload unlawful or infringing Content. Responsibility for a loss depends on the party's breach and applicable law; the presence of third-party Content does not remove Hyred's obligations for services it supplies or any applicable guarantee.
10.2 To the extent permitted by law, Hyred's aggregate liability connected with an Order, including direct damages, indemnity payments and defence costs under clause 9.5 is limited to the amount actually paid by the Brand to Hyred for its most recent relevant task or EUR 20,000, whichever is lower. For a claim by a Creator concerning their assignment, Hyred's damages liability is limited to the agreed compensation for that assignment or EUR 20,000, whichever is lower. Hyred is not liable for indirect, consequential, special, incidental, punitive or exemplary damages, including lost profits, lost opportunities or business interruption, to the extent permitted by law. These limits are aggregate across claims relating to the same affected task or assignment and apply regardless of the basis of the claim, but do not limit liability that cannot lawfully be limited, including intentional misconduct or deliberate recklessness of Hyred's management. The limits concern damages and do not cancel debts for earned compensation, applicable purchase-price repayments, agreed refunds or restoration of credits. They do not cap a user's liability to Hyred for indemnification, breach of confidentiality, infringement, circumvention, or the fine in clause 5.4.4. A Creator's compensation is not a general cap on that Creator's liability. Mandatory judicial powers to assess or moderate a remedy remain applicable, and the same loss cannot be recovered twice.
11. MONITORING/CONFIDENTIALITY
11.1 Hyred may monitor the Platform and Account activity, investigate suspected breaches, remove Content that breaches these Terms, and suspend, freeze or terminate an Account or access to any part of the Platform on the grounds in clauses 4.2, 4.5 and 6.5. Suspected fraud, abuse, circumvention, security threats, unlawful Content or misleading information may justify immediate protective action without prior notice where reasonably necessary and legally permitted. Users are not entitled to continued access while an Account is suspended or after termination. Hyred reserves its rights to payment, damages and other available remedies. Hyred will provide reasons, notice, an opportunity to remedy or review where mandatory law requires them; a user may contact support@hyred.nl. Closure must resolve ongoing assignments, unused services, applicable refunds, credits and earned payouts. Closing an Account does not by itself forfeit undisputed earnings or rights already acquired in Content.
11.2 During the term, each party may receive certain non-public information and materials relating to the other party's business, technology, and products that are confidential and of significant value to that party (“Confidential Information”). Each party shall not use or disclose Confidential Information to third parties except as permitted by this Agreement or as authorized by the prior written consent of the other party. Each party shall use reasonable efforts to maintain the confidentiality of such Confidential Information and neither party shall use less effort than it normally uses with respect to its own confidential information. The foregoing does not restrict either party from disclosing Confidential Information pursuant to an order or requirement of a court, administrative agency, or other government authority (provided the party required to make such disclosure gives reasonable notice to the other party to contest such order or requirement), or confidentially to its legal or financial advisors, or potential buyers or investors. Confidential Information does not include information that: (a) becomes generally known to the public through no fault of the recipient; (b) is lawfully and legally known to the recipient at the time of disclosure without a confidentiality obligation; (c) is independently developed by the recipient without use of or access to the Confidential Information of the disclosing party; or (d) the recipient lawfully and legally obtains from a third party without restrictions on disclosure.
11.3 Storage, deletion and exit. Content rights do not include perpetual cloud hosting. Users must download and back up deliverables while access is available. Availability is governed by the Order, any specifically communicated hosting commitment and mandatory law. Hyred may restrict access, remove files or close Accounts under these Terms without promising a separate export period for every action. Any notice, access or export required by mandatory law or a specific contractual commitment will be provided; immediate protective action remains available where lawful. Removing or hiding a file in the interface may leave restricted operational, dispute, invoice, signed-rights-document, audit or backup copies. Personal-data retention and erasure follow the Privacy Policy and applicable law. Requests may be submitted to support@hyred.nl.
12. STANDARD CONDITIONS
12.1 If for any reason beyond Hyred's reasonable control—including war, terrorism, state of emergency or disaster (including natural disaster), computer virus infection, bugs, manipulation, unauthorized intervention, technical failures, or other circumstances affecting or influencing the administration, security, fairness, integrity, or proper conduct of the Hyred Platform, or if a social media platform changes its terms of service, access, or permission in a way that affects the Hyred Platform—Hyred reserves the right to cancel, terminate, modify, or suspend the Hyred Platform at its sole discretion. This discretion is subject to mandatory law and does not automatically extinguish accrued payment obligations, earned compensation, acquired Content rights or applicable refund entitlements.
12.2 No additional agreement or other Terms (including purchase order or insertion order terms) may be imposed on Hyred unless Hyred agrees to this in writing, and in that case, if any terms in an agreement or other Terms conflict with these Terms, these Terms shall prevail to the extent applicable, subject to the order of precedence set out in clause 1.5.
12.3 If you use the Hyred Platform on behalf of a legal entity, you represent that you are authorized to enter into an agreement on behalf of that legal entity. These Terms constitute the entire agreement between you and Hyred and govern your use of the Hyred Platform, superseding all prior agreements between you and Hyred with respect to the Hyred Platform, but excluding the Hyred Agency Terms and any signed Order Form or Statement of Work, which govern the Hyred Agency Services in accordance with clause 1.5. You shall not assign any rights or obligations under these Terms, in whole or in part, to a third party without Hyred's prior written consent. An unauthorised assignment will have no effect against Hyred to the extent permitted by law. Hyred may assign its rights or transfer this Agreement in connection with a reorganisation, transfer of business or other commercial arrangement, subject to any legally required formalities and mandatory user rights. To the extent legally permitted, the user consents in advance to such a transfer and will provide reasonable cooperation.
12.4 If any provision is invalid, unlawful or unenforceable, it will be severed to the extent required by law and the remaining provisions will continue to apply where legally possible. Where legally permitted, the parties will agree a valid replacement that preserves the original commercial purpose as closely as possible. This clause does not automatically validate an unfair term or require a court to rewrite it in a manner prohibited by mandatory law.
12.5 The Refund Policy is applied to the affected video slots or deliverables when part of an Order is cancelled and the rest continues. A financial refund does not itself cancel an active Creator assignment; Hyred must separately resolve the assignment, delivered work and product handling. Completed work, committed costs and any agreed cancellation charge must be identified, substantiated and disclosed, rather than added as an undisclosed fee after cancellation.
12.6 Credits may be purchased credit, promotional credit or credit issued as a remedy. The applicable issue terms specify any expiry, restrictions and redemption value. A checkout reservation temporarily reduces availability but is not final spending; a cancelled unpaid checkout releases its reservation. A cash refund is returned to the original payment method; an eligible credit-funded cancellation is restored as credit in accordance with the Refund Policy and the applicable credit terms. Promotional value is not automatically redeemable for cash. Hyred must identify the treatment of each portion of a mixed payment.
12.7 Product-cost reimbursement under the Refund Policy requires evidence of delivery and eligible cost of goods. Recovered products and other reimbursements must be taken into account to avoid duplicate recovery. Existing Order entitlements are not removed by a later website revision.
12.8 Cancellation and remedy process. Except for an express cancellation right, guarantee, Refund Policy entitlement or mandatory legal remedy, a Brand has no discretionary change-of-mind refund after committing the assignment or authorised work. Where legally permitted and not inconsistent with an express entitlement, Hyred must have a reasonable first opportunity to correct, replace, reassign or complete affected work before a defect-based refund is required. This does not extend an agreed deadline or the 30-day non-delivery remedy, impose a new condition on an eligible performance refund, or remove included editing revisions. If the Brand changes instructions, delays required products, approvals or information, or stops responding, affected delivery dates are extended by the resulting delay and reasonably necessary rescheduling; Hyred may pause the affected work and recover agreed completed work and substantiated committed costs, subject to the Refund Policy and mandatory law. New charges must be agreed rather than imposed retrospectively. Unaffected deliverables and amounts remain governed by their own purchase and delivery status.
12.9 No provision of these Terms excludes mandatory legal rights.
13. DISPUTE RESOLUTION
13.1 Dutch law governs these Terms, subject to mandatory protections that apply to the user.
13.2 Complaints and disputes may be submitted to support@hyred.nl with the Order or assignment reference, the issue and the requested resolution. The parties will seek a practical resolution; this does not prevent urgent relief, regulatory reporting or the use of a mandatory complaint or legal procedure.
13.3 If the dispute is not resolved, it may be submitted to the competent Dutch court under the applicable jurisdiction rules. Arbitration applies only if the parties separately agree a complete and legally valid arbitration arrangement. These Terms do not impose unspecified mandatory arbitration or waive mandatory rights to bring a claim.
